About the Book:
The movement of `Consumerism` is a fascinating one, and it is indispensable in our daily activities of life. In the opinion of Hon`ble Supreme Court, the Consumer Protection Act, 1986, has been a milestone in the Indian History of socioeconomic protection to consumers and buyers, that is basically directed towards achieving public benefits. The law is an attempt to meet long felt need of protecting the consumer (common man) from disputes for which remedy under the then existing law was not sufficient. The marketing rule no longer is Caveat Emptor, it is Caveat Venditor. And the Consumer Protection Act 1986 has emerged as a much useful and consumer friendly Act after the amendments of 1993.
One can not divide the society into sections of consumers and traders, in a way in which the tenant or labour can be segmented against landlords or employees. Each member of a society is a consumer in itself in one way or another. Can you imagine any person in the society who is not a consumer? Perhaps your answer will probably be a big no. Therefore, without any hesitation we can say that the Act is totally a social measure and not a class legislation. The present volume is an attempt to make the consumer legislation accessible to those concerned through handling of day to day instances to clarify how the law works. The book provides in depth knowledge supplemented by recent relevant judicial decisions which established a new area of consumer responsibility or provided a new application of the existing range of responsibilities. Through out the book a variety of examples illustrate the subject matter. The topics covered in a chapter are discussed under various headings and subheadings, so that they are easily comprehended by the reader, especially those who have no prior knowledge of law. In the last some practical hints have been given in form of Appendix. Some model forms have also been provided with an intention that a common man need not go to a lawyer for filling a complaint, rather he can use these standard forms himself. Addresses of Consumer Disputes Redressal Forums and Voluntary Organisations have also been incorporated for the convenience of consumer.
